Terms of Use

General provisions

This agreement is concluded between Individual Entrepreneur Davydov Sergey Sergeevich, INN (taxpayer number) 110121285409, OGRNIP (state registration number) 319112100012301 (hereinafter "we"), and you - a user of the Vyzov app for iPhone and Apple Watch. The agreement is a public offer (Article 437 of the Civil Code of the Russian Federation). By signing in to the app with your phone number, you accept it in full. If you do not agree with the terms, do not use the app.

How we handle data is described in the privacy policy.

This is an English translation of the Russian document published at vsport.fun/terms. The section "For users in the EU" is an addition for users in the European Union.

The service

Vyzov is a social network for athletes: recording workouts with GPS and Apple Watch, friends, a feed, stories, messages, one-on-one challenges, a leaderboard and people in your city, "Nearby".

The app is free and has no ads. If paid features appear, their terms will be published separately and in advance, and no payment is possible without your explicit consent.

We develop the service: we may add, change and remove features. We announce noticeable changes in the app.

Account

• You may use the app from the age of 13, and under 14 with the consent of a parent or legal guardian. The "Nearby" feature is available from the age of 18. Outside Russia the app may be used from the age of 16.
• You sign in with a phone number from Russia or another country where the app is available. Users from Russia sign in with a Russian number. Do not share your sign-in code with other people.
• One person - one account. Do not impersonate another person or organisation.
• You are responsible for actions performed under your account. If someone has gained access to it, write to us immediately.

Rules of conduct and content

In your profile, workouts, comments, messages and challenge terms, the following is prohibited:

• insults, threats, harassment, humiliation on any grounds, incitement of hatred;
• sexual material, scenes of violence and cruelty;
• spam, advertising, mass mailings, fraud, links to malicious resources;
• calls for violence, promotion of drugs and anything prohibited by the law of the Russian Federation;
• other people's personal data - addresses, phone numbers, photos - without the person's consent;
• other people's texts, photos and trademarks without the right to use them;
• fake workouts and results, other people's workouts under your name, boosting the leaderboard;
• hacking attempts, automated data collection, bypassing restrictions and blocks.

If you have agreed to train with someone from the app, be careful: meet in busy places and tell people close to you where you are.

Moderation, reports and blocking

• Obscene words in messages and comments are hidden automatically.
• You can report any person, workout, comment or message. You can block any person - after that you do not see each other anywhere in the app.
• We review reports within 24 hours. We remove content that breaks the rules and block violators. For gross or repeated violations - without warning.
• If you disagree with our decision, write to davydovsergey96@yandex.ru and we will review it.

Your content

The rights to the texts, photos and workouts you publish remain yours. By publishing them, you grant us a free, non-exclusive licence to store, process and show this content to other users of the app within the visibility you have chosen. The licence is valid while the content is posted and ends when you delete it or your account. We do not use your content in advertising.

You confirm that you have the right to publish what you publish.

Challenges and leaderboard

A challenge is a friendly competition. A "stake" in a challenge is an arrangement between the participants. The service does not accept or transfer money, does not organise gambling or bets, and is not responsible for the fulfilment of such arrangements.

Challenge results and leaderboard places are calculated automatically from the participants' workouts. They may be recalculated if a workout has been deleted or found to be fake.

Health and safety

• You train at your own risk. The app is not a medical service or a medical device and does not give medical advice.
• Heart rate, distance and pace depend on sensors and GPS and may be inaccurate.
• If you have chronic diseases, are pregnant, after injuries and whenever in doubt, consult a doctor. If you feel unwell - stop.
• Follow the traffic rules and do not look at your phone while moving or while riding a bike. A challenge is no reason to risk your health.
• Nutrition norms, meal plans, recipes and workout programmes are for reference only: they are not a medical service, a doctor's prescription or therapeutic nutrition. Under 18 we show only the age-appropriate norm, without diets. If you have diseases, are pregnant, take medication, have pain or are in any doubt, make decisions about nutrition and exercise together with a doctor.
• Coaches and marathon curators are users, not our employees. They state their qualifications themselves, and we do not verify them; a coach's advice is their responsibility and your choice.
• Check the composition of ready-made products against the packaging: the manufacturer may add an allergen.

Limitation of liability

The service is provided "as is". We try to make it work without failures, but we do not guarantee uninterrupted operation or the accuracy of data. We are not liable:

• for interruptions, including those caused by connection problems, internet outages and Apple services;
• for inaccuracy of GPS and device sensors;
• for the content and actions of other users, including when meeting outside the app;
• for harm to health received during workouts if you ignored the app's warnings and a doctor's advice;
• for the advice of coaches, curators and other users, or for recipes and products added by users;
• for decisions about nutrition and exercise that you made yourself based on the app's reference calculations;
• for indirect losses and lost profits.

These limitations apply to the extent permitted by law and do not affect rights that the law does not allow to be limited.

Termination

You can delete your account in the app at any time: Profile - Settings - "Delete account and all data". We may block an account for breaking this agreement. If we decide to close the service, we will announce it in the app at least 30 days in advance.

Changes to the agreement

We publish a new version on this page with its date. We will let you know about significant changes in the app in advance. If you continue to use the app after the new version takes effect, you agree to it.

Governing law and disputes

This agreement is governed by the law of the Russian Federation. We first try to resolve a dispute through negotiation: send a claim to davydovsergey96@yandex.ru, and we will reply within 30 days. If no agreement is reached, the dispute is considered by a court in accordance with the legislation of the Russian Federation, including consumer protection legislation.

For users in the EU

This section is an addition to the English version for users in the European Union.

• Point of contact. Users and authorities can contact us about the service, including under the Digital Services Act, by email at davydovsergey96@yandex.ru, in English or Russian.
• Reporting illegal content. You can report content you consider illegal with "Report" in the app or by email at davydovsergey96@yandex.ru: say where the content is and why you think it is illegal. We review reports within 24 hours, as described in "Moderation, reports and blocking".
• Our decisions. If we remove your content or block your account, we tell you what was done and why, and you can ask us to review the decision by writing to davydovsergey96@yandex.ru.
